1. Agreement

These terms are an agreement between you (the merchant using the app, and the business you act for) and Hoop Interactive LLC ("we", "us") about hoop Search, Filter & Discovery ("the app"). By installing or using the app you accept them. If you do not accept them, do not use the app. The Privacy Policy is part of these terms.

2. What the app does

The app adds a search box, a search results page and product filters to your Shopify store, using the products you publish there, and lets you set how they look and behave.

3. Plans and price

• The app has a Free plan and paid plans, billed monthly or yearly. The plans, their prices and what each includes are shown on the app's Plan page before you choose. Prices are in US dollars, plus any taxes Shopify adds.
• Nothing is charged unless you approve it on Shopify's approval page. Every charge is made by Shopify, on your Shopify bill, under Shopify's billing terms, including how refunds and changes of plan mid-period are handled.
• Your first paid plan starts with a 7-day free trial, once per store. Cancel before it ends and nothing is charged.
• You can change plan or move to Free at any time on the Plan page. Uninstalling the app cancels your plan.
• Your settings are kept when you change plan. Your shoppers see only the features your current plan includes.
• If we change a price, we will tell you in the app at least 30 days before it applies to you, and you can change plan or uninstall before then.

4. Your responsibilities

• You are responsible for the search rules you set (for example synonyms and which products are shown first); they must not mislead your customers.
• Keep access to your Shopify account secure.

5. Acceptable use

Do not misuse the app: do not use it for anything unlawful, interfere with or overload it, try to reach other merchants' data, copy or reverse engineer it except where the law allows, or post abusive or unlawful content on the Feature requests page. We may remove such content.

6. Your content

Your products, settings and the content you add stay yours. If you post a feature idea, you allow us to use it to improve the app, without owing you anything for it.

7. Our app

The app, its code, design and name belong to Hoop Interactive LLC. We give you a personal, non-exclusive, non-transferable right to use it with your store while these terms apply.

8. Availability and changes

We aim to keep the app running, but we do not promise it will always be available or free of errors. The app depends on Shopify and on your theme, and changes to them can affect it. If the app's search can't start on a page, your theme's own search keeps working. We may change, add or remove features. If we ever stop offering the app, we will give you reasonable notice.

9. Ending

You can stop at any time by uninstalling the app; what then happens to your data is described in the Privacy Policy. We may suspend or end your use of the app if you seriously or repeatedly break these terms, or if the law requires it, telling you why where we can.

10. Disclaimer

The app is provided "as is" and "as available". As far as the law allows, we give no warranties, express or implied, including that it will meet your needs, be uninterrupted, or be free of errors. Nothing in these terms removes rights you have under consumer law that cannot be excluded.

11. Limitation of liability

As far as the law allows, we are not liable for indirect or consequential losses, such as lost profits, sales, data or goodwill. Our total liability for any claim about the app is limited to the greater of the amount you paid us for it in the 12 months before the claim and 100 US dollars. Nothing in these terms limits liability that cannot be limited by law, such as for fraud.

12. Changes to these terms

If we change these terms, we will update the date at the top. For important changes we will tell you in the app or by email before they take effect. If you keep using the app afterwards, the new terms apply; if you do not agree, you can uninstall it.

13. Law

These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law rules, and any dispute will be heard by the state or federal courts located in Wyoming. If you are a consumer, this does not take away the protection of mandatory laws of the country where you live.
